Trust Deed Of ‘Uttarakhand Tourism Professionals Association’


This Deed of Trust executed on this day 5th of June, 2016 by Shri Sunil Dutta Bahuguna, S/o Late Shri Raghubir Dutta Bahuguna, Resident of 61 B Pocket C-1, MayurVihar, Phase-3, Delhi-110 096hereafter called the "Settler of the Trust".

Whereas the “Settler” is desirous of constituting a public charitable trust for the welfare of human development without discrimination on the basis of religion, race, caste, color, creed or nationality.

Whereas for the said purpose, the “Settler” has set apart and dedicated a sum of Rs. 1001/- (Rs. One Thousand One Only) freely and voluntarily out of his acquired money, which he has handed over to the trustees hereafter mentioned to hold the same upon trust together with all the income arising therefrom and all the accumulations for the intent and objects herein contained;

And whereas the “Settler” desires to reduce to the writing the terms of the trust.

Now this Deed witnesseth that

5. AIMS & OBJECTIVES: -

That the objectives of the Trust ‘Uttarakhand Tourism Professionals’ Association’ shall be wholly for the public and charitable purpose and its income shall be wholly for the public and charitable purpose without prejudice to the provisions aforesaid, and the following shall be deemed to be the principal objectives:

  1. To establish a network and develop cooperation among people with origin in Uttarakhand working in tourism sector in different parts of the country with an aim of creating new job opportunities for them.
  2. To create awareness and conduct training and research in the field of tourism in areas such as new destinations, and eco-tourism villages, homes stays etc. with aim to promote tourism in Uttarakhand based on its values and culture.
  3. To conduct, encourage and promote studies and research in the field of Yoga, Meditation, Nature care etc.
  4. Hold seminars, workshops, and to establish educational & vocational training institutions, in urban, rural and backward areas, and to provide professional assistance with regard to promotion of tourism.
  5. To promote and revive the traditional arts and crafts of Uttarakhand, and create new opportunities for various art forms such as literature, Folk dances, Music and other performing arts.
  6. To provide all types of assistance and opportunities to children and young artistes from Uttarakhand.
  7. To grant scholarships and provide financial aid to poor and meritorious students in the field of the profession of tourism.
  8. To print, publish or/and distribute magazines, newsletters or any other literature in print or digital media for the promotion of the above objects.
  9. To give or award prizes for excellence in the field of Tourism sector in Uttarakhand.\
  10. To initiative talks with local and central government as well as private bodies for the promotion of tourism in Uttarakhand.
  11. To study the impact of tourism on Society & Culture, and tourism as a measure for poverty eradication and generation of employment in Uttarakhand state.
  12. To explore ideas of Green (Eco) tourism, through Carbon foot printing & being socially responsible.
  13. To use the audio-visual media for furtherance of its aims and objects.
  14. To work for empowerment and capacity building of women and girls through Skill training, Seminar, workshops and any other mode useful for upliftment of women in society. To organize adult educational programs for illiterate women from marginalized sections.
  15. . To coordinate with the government in providing health & nutrition services for women, children and elderly people.
  16. To create awareness among the people with the help of communities, panchayats, schools and colleges regarding HIV/AIDS, TB, etc. and help HIV/AIDS patients with necessary support and enable them to get restored in their family
  17. To set up a psychological and career counselling centre for adolescents, their parents and teachers and to organize workshops and conduct outreach programs in schools, colleges and within the community with the support of various stakeholders.
  18. To promote research on social problems to assist the government formulate tourism policy and develop new strategies for development.
  19. To provide entrepreneurship and skill development training in the field of tourism to socially and economically weaker sections of population for self-employment.
  20. To bring synchronization between tourism and other sectors/industries for the generation of employment and revenue.
  21. To market Uttarakhand tourism to Indian and foreign tour operators, and make them aware of the scope and opportunities for tourism in Uttarakhand through print media, news channels, blogging, internet website, e-mailers, etc.
  22. To maintain high professional and ethical standards in the tourism industry of the state through active participation of people engaged in the field of tourism.
  23. To organize seminars, meetings, press conferences and other events for the promotion of tourism in the state.
  24. To support the local communities and tourism entrepreneurs with training and awareness programmes to increase local livelihood opportunities, and protect local environment and cultural heritage.
  25. To promote tourism in Uttarakhand through spreading awareness about the importance of cleanliness of sightseeing places such as lakes, rivers & temples, trek routes, camping sites etc.
  26. To help entrepreneurs in developing new tourism products like sports tourism, village walks & stay, community based tourism, eco tourism etc.
  27. To extend support in improving accommodation facilities for tourists in Uttarakhand by giving professional inputs to hotels, motels, lodges, guesthouses, home stays as well government run GMVN & KMVN rest houses.
  28. To work closely with other associations and agencies working in the field of tour operation, Hotels, transport, adventure activities, river rafting, trekking operation etc. at state, national and international level to improve tourism in Uttarakhand.
  29. To do plantation of trees as a measure to control global warming and land erosion.
  30. To establish libraries and other educational institutions for promotion of education in tourism.
  31. To establish, support, maintain or aid other institutions and facilities for the benefit of tourism in Uttarakhand.
  32. To carry out activities related to water conservation, treatment of water and promoting technologies for purifying water so as to make drinking water available to the masses and reduce water pollution in water bodies.
  33. To open branches of the organization in the state and other parts of the country for the promotion of its aims and objectives.
  34. . To undertake and run welfare and development projects for women, children, rural youths, poor peasants, disables, tribal people and other marginalized and deprived social groups in the field of education, health, environment, income generation activities for weaker sections, promotion of science and technology, rural development, promotion of Indian art &culture, tribal welfare, application of non-conventional energy resources, consumer awareness, road safety, drug abuse prevention, integrated development, income generation activities through self-help groups.
  35. To provide counseling and rehabilitation facilities to victims of alcoholism and drug abuse, and provide mental health-care to improve the quality of life
  36. To promote Indian system of medicines such as Ayurveda, Siddha, Unani, Homoepathy, Yoga & Naturopathy, through conducting training and holding health melas, health camps, mobiles dispensaries, growing and distributing of medicinal plants and encouraging people to cultivate these medicinal plants in their kitchen gardens.
  37. To organize relief camps and rehabilitate people effected due to Natural calamities like droughts, flood, earthquake, landslides, thunderstorm, fire and epidemic etc. To create disaster preparedness and conduct higher research in the field of disaster management.
  38. To protect environment through training, research and creating awareness through seminars, workshops, awareness campaigns and eco-clubs, and use of environmentally sound and appropriate technologies, Biodegradation of wastes, renewable energy, biodiversity, occupational health, desertification, wildlife protection etc. and promote sustainable development through waste land development, water shed management, environment awareness at grass-root- level, develop nurseries, kitchen gardens etc. To promote social forestry and to take measure to prevent pollution of water soil, air etc.
  39. To give awards and medals to accord recognition for outstanding contribution made by individuals and institutions towards national reconstruction, social service and intellectual work bringing glory and contributing to the development of the country. To help and assist deserving social organizations and other such trusts which are engaged in social welfare. To institute scholarships, stipends, medals, prizes and monetary assistance etc. to help and encourage meritorious students, scholars, teachers and artists for pursuing their learning and profession.
  40. To impart training in handicraft/textiles, and make arrangements for marketing and promotion of Handloom, Handicrafts and Khadi. To organize exhibitions and fair for the sale of various handlooms and handicraft items.
  41. To work for Non-conventional energy programme by involving National level and grass root level NGO’s and also to promote renewable energy sources technologies/activities and programme for sustainable development at grass roots level such as bio-gas, solar cocking, solar, thermal, wind energy, Gobar gas, solar driers, solar lantern etc.
  42. To help, maintain and run welfare institutions for down trodden, destitute, street children, beggars and women in distress such as short stay homes, hostels, clinics, vocational training centers, orphanages, adoption homes, old age homes, day care centers, creches, counseling centers, schools, community halls, night shelters, libraries, museums, laboratories, workshops, shelter homes etc. to provide them relief and raise their socio-economic standards.
  43. To work for integrated development in rural, urban and tribal areas by construction of Inter village Roads, Community halls, hospitals, Schools, Colleges, Polytechnic, Training Centres, libraries and other institutions. To provide low cost houses, pure drinking water, toilets, ponds, tube wells, water storage, land and water shedding etc. and run similar welfare schemes to uplift oppressed communities.
  44. To run various welfare schemes in the field of education such as basic education, Non-formal education, Pre-school education, bridge courses, adult education, vocational training, distant education, higher education etc. to provide quality and affordable education/skills to uneducated /unskilled people belonging to weaker sections.
  45. To prints publish sell, distribute journals, periodicals, books, leaflets or any other media on social issues or for promotion of any particular object of the society/state/national or to establish relation between different organization/ associations at regional and national level or upliftment of medicine, Art, Science and Agriculture for the purpose of students and general public.
  46. To promote, protect and preserve the rich cultural heritage of India with special focus on Himalayan culture through holding cultural programmes in the field of literary, visual and performing arts, conducting research, preserving rare manuscripts and artifacts, developing museums etc. and producing books, films and audio-visuals etc.
  47. To provide industrial education, research and training for all segments at all levels, viz. craftsmen, technicians, professionals and post graduate levels through training before and after education and during vacations in various skills, arts and crafts as well as various trades and branches of Engineering, Technology, Industry, Commerce and Applied Arts, Bio-Technology, Agriculture, Horticulture, Sericulture, Forestry, Textile. Industrial Design, Home Science, Dietetics and Nutrition, Tourism, Information & Technology etc.
  48. To provide training and set up food processing centres for various fruits, vegetables, and establish industries of such types in the suitable places of rural areas.
  49. To conduct research and provide training in the field of cultivation of herbs, Aromatic & Medicinal Plants, Seed & Nursery, Biotechnology, Tissue Culture, Bio-pesticides and Organic Foods, Promote Bee-keeping, water conservation, irrigation, wasteland development, fisheries, poultry, veterinary services, dairy farming, aviary and aqua-cultural to introduce new technologies to farmers, develop publicity material, to establish nutritional gardens in rural areas and distribute fruits plants and vegetable seeds, and conduct techno-economic feasibility studies. To establish experimental farms and research stations to conduct experiments, tests and research for developing better qualities of food grains and cattle, improving other agricultural crops, produce, seeds, fodder crops and cattle feeds of all kinds.
  50. To organize, sponsor, co-ordinate and conduct national, regional and international meetings, seminars, symposium, workshops, discussions, debates, demonstrations exhibitions, street plays, cultural events, promotional activities/programmes, film shows to give programmes through video, television and other media.
  51. To co-ordinate and network with individuals, voluntary organizations, government agencies, banks and other instructions engaged in development activities with a view to assist grassroots organizations and individuals in executing and implementing various schemes.
  52. To produce, sponsor and hold shows of documentaries, feature films, serials, talk shows, audio-visuals, performance of street plays, dramas, operas, radio and television entertainment/awareness programmes and other cultural programmes and event.
  53. To encourage children and youths to participate in sports and adventure activities by holding training camps, exhibitions, educational tours and training programmes for summer vacations. Create social awareness among youth so as to make them better and more responsible citizens and inculcate in them a feeling of communal harmony, mutual brotherhood and national integration.
  54. To carry out welfare measures for people handicapped during service or war. To run various welfare programmes for the rehabilitation of their family members and dependants.
  55. To make agreement or arrangement with Government, semi-Government, Non-government Bodies/Societies/International agencies, Organizations or Groups of individuals to obtain financial aid in whatever manner for fulfillment of aims and objectives of the trust.
  56. To utilize fund towards capital and recurring expenditure of the trust, making suitable investments or dealing with the fund in any other lawful manner the trust may deem necessary.
  57. To draw, make, accept, endorse, execute, discount, sign, issue or deal in other appropriate manners with drafts, cheques, certificates, receipts, government securities, promissory notes, bills of exchange of other instruments and securities whether negotiable or transferable or not.
  58. To create administrative, ministerial, technical and other posts or cadres for running the trust and to appoint suitable persons to those posts or cadres in accordance with the rules framed in this behalf by the trust.
  59. To create and maintain a fund(s) with subscriptions, contributions or donations received from Governmental agencies as well as private organizations and with money raised by the trust in any other lawful manner.
  60. To borrow or raising or securing the payment of money by issue of bonds, securities or in such other manner as the trust may deem necessary.
  61. To do all such acts, activities and programmes, which are necessary for the fulfillment of the objectives of ‘Uttarakhand Tourism Professionals’ Association’ and are incidental to the aim and main objectives of the trust.
  62. All the income, earnings, movable, immovable properties of the ‘Uttarakhand Tourism Professionals’ Association’ shall be solely utilized and applied towards the promotion of its aims and objects only as set forth in the trust deed and no profit on therefore shall be paid or transferred directly or indirectly by way of dividends, bonus, profits therefore in any manner whatsoever to the present or past trustee of the ‘Uttarakhand Tourism Professionals’ Association’ or to any person claiming through any one or more of the present or past members. No trustee of the ‘Uttarakhand Tourism Professionals’Association’ shall have any personal claim on any movable or immovable properties of the ‘Uttarakhand Tourism Professionals’ Association’ or make any profit, whatsoever, by virtue of his membership.

6. POWERS OF THE TRUST
To do all that is necessary and incidental for the purpose of achieving the objects mentioned above, the trust shall have the following powers:

  1. Acquire by purchase, lease, mortgage, will, gift, grant, legacy, bequest, exchange, right privilege or otherwise from any person, company, society, Government, Institution, Organization or privilege or otherwise from any person, company, society, Government, Institution, organization or anybody what so ever, movable or immovable properties of all description deemed necessary or useful for any purpose of the Trust.
  2. Erect building or structure whatsoever to further any purpose of the trust and to maintain, develop, improve, alter, repair, demolish or reconstruct the same or any portion thereof.
  3. Take or receive any gift whether money or property movable, immovable, donations in form of debentures, stock shares or securities in any company or society whether incorporated or not or whether by gift by a person living or by legacy bequest will or foundation and whether subject to any special trust or for works connected therewith and to take steps for the securing of such contributions for funds as from time to time be deemed expedient.
  4. Alienate by way of sale, mortgage, lease release, charge, hypothecate, pledge exchange hiring out, gift of properties or funds of the Trust or any portion or portions thereof including subscriptions, contributions, assistance pecuniary or otherwise to such institution, bodies or persons as from time to time deemed necessary or expedient.
  5. Lend money free of interest, invest, lay aside, deposit in Bank or otherwise deal with money or funds of the Trust not immediately required for the objects of the Trust and to subscribe or purchase, acquire hold, sell, endorse and negotiate in debentures, stacks, shares and securities of every description in the money market, in conformity with be provisions contained in Section-20of the Indian Trust Act, 1882.
  6. Borrow or raise funds with or without security in any manner the trust may think fit and repay the same.
  7. Negotiate with and enter into arrangements, with any Government, Authority, Corporation, Board University or other Public Bodies as may seem conducive to the promotion or accomplishment thereof and to obtain, collect, receive such grants, loans, allowances, rights, concessions and privileges as may seem to comply with the objects and utilize the same.
  8. In general to do or cause to be done apart from all the acts stated above, all such other acts or things as shall be conducive to the interests of the Trust provided such things or acts be neither contrary to nor inconsistent with the spirit and principles of law under which,has the trust been established.
  9. That for carrying out any of the said powers or objects, the trustees shall be entitled to utilize any part of the corpus of the trust property for making any capital investment.
  10. All such investments can be made in the name of the trust or in the name of the trustees as the trustees may think convenient or as required by the terms of investment.
  11. That the trustees shall have full power to file and defend suits, appeals, applications etc. and any one or more of them, being duly authorized and shall have power to declare, sign and verify all plaints, written statements, memos of appeal, cross objections, applications, affidavits etc. and to accept summons, notices etc. and to appear in any place or places in the Union of India before any court, any tax authority, officer or tribunal and to compound all actions, suits and other proceedings and all differences, disputes and to refer any such difference, disputes to arbitration.

7. DURATION OF THE TRUST
The trust‘Uttarakhand Tourism Professionals’ Association’ hereby created shall be irrevocable and its duration perpetual and permanent, subject to other residuary clauses of this deed.

8. “TRUST PROPERTY”

  1. The term “TRUST PROPERTY” shall mean and include the said sum of Rs.1001/ -(Rupees one thousands one only) set apart by the ‘settler’ and further grants, donations, contributions of money and /or property movable or immovable that may be made available by the founder or by others from time to time.
  2. The Trust property shall vest in the General Body of Trustees comprising of Trustees who will hold, manage and administer the trust in accordance with the terms and conditions hereof.

9. Membership:
The membership of the trust will be open to any person or persons who arefrom Uttarakhand working in the field of tourism & hospitality sector, and have attained the age of majority and abide by the terms and conditions for the Trust, but subject to the approval of the governing body. There will be three types of membership in the trust.

A) Founder Member
B) Ordinary Member
C) Associate Member

A) Founder Member:
Those members who are associated with founding of the trust will be the Founder Members. They willcontinue to be members for whole life.

B) Ordinary Member:
Individuals who are native/original residents of Uttrakhand working in Tourism & hospitality sector, would be entitled to become on Ordinary Member on payment of prescribed fees and on being admitted by the governing body.

C) Associate Member:
The organization will also have associate members living and working in Uttrakhand in tourism & hospitality sector. But these associate members will have neither voting rights, nor they can be elected in Governing Body.

10. Subscription:
The Membership fee for the founder, ordinary and associate members will be Rs1000/- and annual subscription fee will be Rs.500.

11. Refusal:
The governing body of the trust may refuse Membership to any person, provided reasons for refusal shall be communicated to the person concerned in writing.

12. Expulsion:
The governing body of the trust may expel any of its ordinary member on the following grounds:

a) On his/her death.
b) If the member fails to pay the timely subscription continuously for three monthsfrom the due date of paying the subscription.
c) If the member works against the aims and objects of the trust.
d) If the member tenders his/her resignation.
e) If the member fails to attend three meetings of general body continuously without intimation.The reasons of expulsion shall be communicated to the concerned membereachexpelled member shall have a right to appeal to the general body which may or may not accept the appeal.

13. Appeals:
All the appeals shall be referred to the general body of the trust & the decision of the general body shall be final. The reasonfor rejection shall be communicated to the member concerned. This clause willbe applicable as mentioned in termination clauses.

14. Re-admission:
A member expelled by the general body can be readmitted provided the member concerned pays all outstanding dues. The decision of the general body shall be final in this regard.

15. Rights & Privileges of members:
Every member shall have the right to participate in the general body meeting and shall also be entitled to inspect the record of the trust with prior approval of governing body. Besides every member except Associate Membersshall also have a right to vote in its meetings. Every member shall be entitled to participate in meetings, functions and get together programmes of the trust.

16. General Body of the Trust:
There shall be a general body of the trust consisting of all the members. The meetings of the general body shall be held once in a financialyear with 1/3 quorum. If a meeting is adjourned for want of quorum, there shall be no condition of quorum for a subsequent meeting. An emergency meeting of the general body may also be summoned on the written request of 3/5 members with ten days prior notice for such meetings. The notice period of general body shall be ten days. The following business shall be transacted in these meetings.
a) To prepare annual programmes and policies.
b) To discuss and to decide all such other matters and issues those are directlyor indirectly related to the affairs of the Trust.
c) To pass annual budget of the Trust.
d) To appoint a qualified auditor who will annually audit the accounts of the Trust's funds.
e) To consider any business brought forward by the governing body.

17. Governing Body:
There shall be a governing body of the trust to look after and manage the day to day affairs of the trust. It shall consist of minimum 7members including the office bearers. The Governing Body will consist of 7 permanent members and 8 ordinary members. All the seven founder members will remain in the Governing Body for their lifetime unless any of them resigns or removed by two third majority of the Governing Body. Eight ordinary members will be elected by General Body. The meetings of the governing body shall be held after every three months with1/3 quorum. No, quorum is required in the adjourned meeting. An emergency meeting of the governing body may also be summoned on the written request of 3/5 members of 10 day notice of the meeting. The notice period of the governing body shall be 10 days. The founder members of Governing Body will have the power to veto any decision taken by Governing Body by two third majority. The following business shall be transacted in these meetings:

a) To take necessary step for the implementation of all the programmes and policies drawn by the general body.
b) To pass the necessary expenditure tomeet the requirements of the trust.
c) To take decisions on application for membership.
d) To appoint committees for disposal of any business of the trust or for advice in matters pertaining to the Trust.
e) To arrange finance if required from banks institutions or individuals on reasonableterms and conditions and the governing body as a whole is liable for its return.
f) To receive to have custody of and to expend the funds of the Trust and to manage the properties of the Trust.
g) To sue and defend illegal proceedings on behalf of the Trust.
h) To take all legal steps, which may appear beneficial for the smooth and better management of the Trust.
i) To delegate such powers as it may think necessary to the President, Treasurer andGeneral Secretary for incurring expenditure for carrying on the business of the Trust, proper maintenance of accounts, making appointments and enforcingdiscipline, in the Trust, and allied matters.

18. Election:
The Governing Body of the Trust shall be elected for a term of three years in the general body meeting. The raising of hands shall be the mode of election. The newly elected governing body list should be attested by three outgoing office bearers.

19. Office Bearers and Their Duties

  1. President:
    • a. He/She shall preside over all the meetings of general body and governing body.
      b. In case of equality of votes in any meetings he shall tender his casting vote.
      c. He/She shall supervise work of other office bearerfrom time to time and exercise such powers as may be delegated to him by the governing body.
  2. Senior Vice President:
    Senior Vice President will be in-charge of creating Sub Committees on different subjects. He will also be responsible for checking and approving of new applications of memberships.
  3. Vice-President:
    In the absence of the President, the Vice-President shall enjoy all powers and duties which are entrusted to the President. He will also assist the President in his duties from time to time.
  4. General Secretary:
    • a. The General Secretary shall be the Executive Head of the Trust. He/She shall represent the Trust in all public and private offices.
      b. He/She shall keep and types of record of the Trust including the register ofmembers containing therein the names, addresses another brief particulars.
      c. He/She shallundertake alltype of correspondence on behalf of the Trust.
      d. He/She shall convene with the consultation with the President the meetings of the general body, governing body, andhe shall also inform every member regarding time, date andplace of the meeting through a ten day written notice.
      e. He/She shall exercise such powers as may bedelegated to him/her by the governing body.
  5. Joint Secretary:
    He/She shall assist the General Secretary in the day to day work and shall exercise such powers as may be delegated to him/her by the governing body.

  6. Treasurer:
    He/She shall collect subscriptions, gifts, grants in aid and donations from themembers and the general public and work for generating financial resources of the Trust. He/She will exercise such powers as may be delegated to him/her by the governing body.
  7. Members:
    They shall assist in the day-to-day work of the Trust as directed by the President and General Secretary.

20. Filling up Casual Vacancies.
The causal vacancies may be filled up by the resolution passed by majority of votes by the governing body upto the next election.

21. Financial Year.
The financial year of the Trust shall be from 1st April of a year to 31st March ofnext year.

22. Source of Income and Utilization

(a) Sources of Funds:
(i) by admission fees;
(ii) by membership fees;
(iii) by grants, contributions and donations from members;
(iv) by service charges;
(v) by sale of publications;
(vi) by grants, donations and contributions from non-members, Government and local bodies etc.
(vii) By organizing seminars & conventions

(b) The income and property of the trust from whatever source derived shall be spent and used solely for the promotion of the aims and objects as set out in the memorandum of the trust. Accounts will be audited every year.

23. Legal Proceedings
The Trust may sue or be sued in the name of the President/General Secretary as per provisions laid down under the relevant section of the law as also applicable to the Union Territory of Delhi.

24. MINUTE BOOK
Minute Book shall be maintained at the office by the Governing Body of trustees, minutes of all the meeting, appointments and entry into the office of every new trustee and all other proceedings of the Governing & General Body of the trustees shall be signed by the Chairman/chairperson of the meeting either at the conclusion of the meeting or at the subsequent meeting when they are duly confirmed.

25. AUDITORS
The yearly account of the Trust shall be from 1st April to 31st March each financial year and the accounts will be audited by a Chartered Accountant appointed by the Trustees for the said period and fees, if paid, shall be outgoing of the income and expenditure of the Trust.

26. BANK ACCOUNT OPERATIONS
The funds of the Trust shall be kept in a bank. The bank-account of the Trust shall be operated jointly by the treasurer with either of President or General Secretary. The Governing Body may also authorize any other person to operate the Bank Accounts.

27. INCOME TAX EXEMPTION
All these powers of the trustees prescribed herein of the trust deed shall be exercised as to ensure that the income of the trust would be exempted under section 10(22), 10(22A) and /or 11 of the Income Tax Act 1961 as amended from time to time. It is clarified that the power of investment of the trust funds including those mentioned in clauses above shall be exercised in such a manner so as to ensure exemption of the income of the trust under the relevant provisions of the said Act.

28. ALTERATION OF RULES OF TRUST
The trustees, by a majority are empowered to alter the rules governing the administration of the trust in manner not inconsistent with the objectives of the trust provided in the trust deed.

29. PROVISION OF TERMINATION OF THE TRUST
In the event of the termination of the trust or if this trust should fall in any reason, the trustees shall make over or transfer the funds and properties of this trust to any other trust or Institution having objects generally similar to those of this trust and to which are exempt under section 80-G of the Income Tax Act 1961, if the resolution to that effect is passed by the trustees unanimously or by not less than three fourth majority provided that under no circumstances the properties or assets of the trust at any time be distributed among the author or the trustees.
